However, with its low barriers to entry and broad product catalog, Tokopedia faces a growing challenge: counterfeit goods. To address this, Tokopedia has invested significantly in seller education campaigns and advanced technologies to proactively detect and remove infringing content.

How Tokopedia Protects IP Rights

Tokopedia has implemented a robust IP protection framework to combat counterfeit listings and safeguard brand integrity. The process is built on several key pillars:

  • Proactive Monitoring and Seller Education: Tokopedia uses automated tools and algorithms to identify and remove some infringing products before they reach customers. It has also launched campaigns to educate sellers about their obligations under Indonesian IP law.

How to Report IP Infringement on Tokopedia

The Process:

  1. Log In or Create an Account. You’ll need to register and verify your identity to access the portal.

  1. File Your Infringement Notice. Once approved, submit a detailed infringement notice, including:
    • Links to the infringing product (specific product pages only, not general storefronts).
    • A clear explanation of how the product infringes on your IP.
    • Evidence supporting your claim, such as side-by-side product comparisons.
    • Identity verification documents (ID card or employment statement letter).
    • Power of attorney if you’re a representative.

  1. For trademark cases, you’ll need a valid trademark certificate registered in Indonesia. For copyright complaints, you’ll need a copyright certificate or a signed claim statement. Industrial design and patent reports must also include valid certificates, proof of identity, and other supporting documentation.
  2. Track Your Reports. All submissions and their statuses can be tracked in the IP Protection Portal. Tokopedia typically reviews and responds to these requests within 14 days.

What About Tokopedia’s TikTok Shop Partnership?

For products listed through Tokopedia’s partnership with TikTok Shop, IP complaints are handled separately via the TikTok Shop Intellectual Property Protection Center (IPPC). Brands can file an infringement notice directly through this dedicated portal to ensure prompt action on counterfeit or infringing listings.
